Terms of Service

These terms govern your use of the Nolario website at nolario.com, the Nolario waitlist, and the Nolario software service once it becomes available. By using the website or joining the waitlist you agree to them.
1. Provider
Nolario is operated by Matteo Cacic, Dr.-Ambros-Giner-Weg 13a, 6065 Thaur, Tyrol, Austria. Contact: matteo@cacic.at. Full details are in the legal notice.
2. Current status of the service
Nolario is in development. At the time of writing, the website and the waitlist are the only things on offer, both free of charge, and no paid service is being sold. Sections 5 and 6 describe the paid plans and take effect for you only from the moment you actually subscribe to one.
3. The waitlist
Joining the waitlist costs nothing and creates no contract for the service and no claim to access. We may open access in groups, in an order of our choosing, and we may decide not to open it at all. Prices, plans and features described on this website are our current intent, not a binding offer, and may change before launch.
You can ask us to remove you from the waitlist at any time by replying to any email you receive from us or writing to support@nolario.com. What we store and why is set out in the privacy policy.
4. Accounts
An account is personal to you. Keep your credentials confidential, and tell us promptly if you believe someone else has gained access. You are responsible for activity carried out through your account, except where that activity was not attributable to you.
You must be at least 18 years old and legally able to enter into a contract. Nolario is built for business use.
5. Paid plans, billing and cancellation
This section applies from the moment paid plans become available and you subscribe to one.
- Plans are subscriptions billed in advance for the chosen period, monthly or annually. The price and period that apply are the ones shown at checkout.
- Payments are processed by Stripe. We do not receive or store your card details.
- A subscription renews automatically for the same period unless it is cancelled before the end of the current period. You can cancel at any time, with effect from the end of the period you have already paid for.
- Where a free trial is offered, the terms shown with that trial apply. We will say clearly when a trial converts into a paid subscription.
- We may change prices for future billing periods. We will tell you in advance and you can cancel before the change takes effect. A change never applies to a period you have already paid for.
Right of withdrawal. If you are a consumer within the meaning of Austrian and EU law, you have a statutory right to withdraw from a distance contract within 14 days without giving reasons. Nothing in these terms limits that right. Where you expressly ask us to begin providing the service during the withdrawal period and acknowledge that you lose the right once it has been fully performed, the statutory consequences apply.
6. Your content and your accounts at other services
Nolario connects to accounts you already have, such as Gmail, Outlook, Slack, Microsoft Teams and calendars, and processes the messages in them on your behalf. Those messages, and anything you write or upload, remain yours. We claim no ownership of them.
You grant us only the permission we need to run the service for you: to receive, store, display, rank and process that content, and to pass the parts required for a given feature to the providers named in the privacy policy. You can revoke a connection at any time in the settings.
You are responsible for having the right to connect the accounts you connect, which matters if a mailbox belongs to your employer or contains other people's data.
7. Acceptable use
You agree not to:
- use Nolario to send unsolicited bulk messages, or for anything unlawful;
- attempt to gain unauthorised access to the service, other users' data, or the systems it runs on;
- interfere with the service's operation, for example by automated requests at a volume it is not designed for;
- resell or sublicense access, or share one account between several people, unless a plan says otherwise;
- reverse engineer the service beyond what applicable law expressly permits.
8. Artificial intelligence, and what it can get wrong
Nolario uses AI models to rank messages by importance, to summarise them and to draft replies. AI output can be wrong, incomplete or misleading, and importance ranking is a judgement, not a fact.
Check anything that matters before you act on it, and read any draft before you send it. Nolario is a tool to help you decide, never a substitute for your own decision, and it is not legal, financial, medical or tax advice.
9. Availability
We aim for a reliable service but do not promise uninterrupted availability. Maintenance, changes at the providers we connect to, and faults outside our control can all interrupt it. We may change, add or remove features. If we discontinue a paid feature you rely on, we will give you reasonable notice and you may cancel.
10. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for personal injury, and wherever mandatory law imposes liability, in particular under the Austrian Product Liability Act.
For slight negligence we are liable only for breach of an obligation that is essential to the purpose of the contract, and then only for the damage typically foreseeable in a contract of this kind. Liability for slight negligence is otherwise excluded. Nothing here limits your rights as a consumer under the Austrian Consumer Protection Act.
11. Term and termination
You may stop using Nolario and delete your account at any time. We may suspend or terminate an account for a serious or repeated breach of these terms, and will normally warn you first unless doing so would be pointless or unreasonable.
After termination you can export or delete your data as described in the settings and the privacy policy.
12. Changes to these terms
We may update these terms, for example when features or legal requirements change. If you have an account we will tell you before a material change takes effect and give you a reasonable period to object or cancel. Continuing to use the service after that period counts as acceptance.
13. Governing law and place of jurisdiction
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you can bring proceedings in the courts of your place of residence.
If any provision of these terms is or becomes invalid, the remainder stays in force.
